§ 74-452. Exception for previous side setback waivers.

Notwithstanding any provision of this article or this chapter, for structures that
were constructed prior to November 11, 2003, within setbacks or other construction
boundary limits with approval of adjoining property owners and consent of the board
of commissioners in conformity with the zoning ordinances as they then read, such
structures shall be deemed conforming to the zoning ordinance and, in the event of
damage or destruction, regardless of the extent, such structures can be rebuilt, repaired
or restored in their original location.
