§ 74-447. Nonconforming structures.

  • Any structure that is nonconforming because it has dimensions which do not meet the requirements of the town zoning and/or subdivision ordinances shall be allowed to continue in existence, subject to the following limitations:

    (1)

    Said structure may not be expanded, extended or altered in any way that would increase its nonconformity;

    (2)

    Such structure may not be repaired or replaced at any time it is damaged or destroyed to the extent that 50 percent or more of the value of the structure immediately prior to the its damage or destruction will have to be expended in order to restore or reconstruct such structure.
