§ 74-181. Other restrictions.

  • All architectural plans for shopping centers, retail stores and other commercial use structures and additions, modifications or changes thereto, shall indicate the type of construction and proposed finishes for the exterior wall facings. The proposed exterior structures as shown on the architectural plans must comply with the following specifications and/or restrictions:

    (1)

    The total area of glass, windows, and any similar transparent or translucent device for any side of a commercial structure shall not exceed 60 percent of the surface area for that side of the building, and must be positioned uniformly along the face of the structure except that this percentage may be increased by the local fire marshal to bring the structure into conformity with the state fire code. Any breaks or devices in the continuous roofline, such as dormers, must be approved by the planning board and the board of commissioners. Any glass component of these devices shall be considered as part of the allowable 60 percent for each building face.

    (2)

    No glass, window or similar transparent or translucent device on any exterior wall may be placed above the lesser of the height of the lowest part of the ceiling or the lowest part of the roof.

    (3)

    No facade, loadbearing, nonbearing wall or partial wall which is parallel to the exterior wall may be placed within ten feet of any glass window, or similar transparent or translucent device.

    (4)

    The placement of towers, spires, and other structurally nonfunctional additions to any commercial structure above the lowest point of the roofline is prohibited; however, an exception to this rule would allow the construction of a church which included a steeple.

    (5)

    A building face shall not have any wall component which exceeds 40 feet in length without an offset of the building face by a minimum of four feet in depth for a maximum of eight feet in length.

    (6)

    Metal siding shall not compose more than 50 percent of the overall building materials. Exterior siding such as brick, cedar shakes, wood, or other textured sidings are encouraged. Reflective surfaces shall not be used.

    (7)

    All rooftop mechanical equipment shall be shielded from ground level view.

    Outdoor display areas shall not be allowed unless specifically authorized by permits granted by the town board of commissioners and shall not be conducted in areas designated for parking.

    (11)

    Vending machines shall be located within the structure.

    (12)

    Coin-operated amusements rides, and similar activities or devices shall not be allowed.

    (13)

    Sidewalk or tent sales may be allowed when specifically authorized by permits granted by the town board of commissioners.

    (14)

    All mechanical appurtenances shall be located to meet a sound pressure range of less than 60 decibels at all property lines. If necessary, noise buffers shall be constructed on the site to comply with this decibel level.

    (15)

    Unloading/delivery zones shall be located to meet a sound pressure range of less than 60 decibels at all property lines. If necessary, noise buffers shall be constructed on the site to comply with this decibel level.

    (16)

    Designated parking areas shall not be used for display or storage of merchandise and shall be maintained and kept free of trash.

    (17)

    All cart return areas shall be designated on the site plan.

    (18)

    All dumpster areas shall be visually buffered on three sides by opaque wooden screening a minimum of 12 inches above the top of the container.

    (19)

    A signage plan depicting all proposed sign locations and dimensional information shall be submitted with the site plan. All signs shall be constructed to comply with the applicable town building codes and building permits shall be obtained from the town building inspector before their installation.
