§ 74-180. Closure procedures for commercial structures.

  • (a)

    The town shall be notified in writing in advance of the closing of any commercial structure or multiple building projects. This notification shall include alternate plans for the structures and/or marketing programs for the reuse of the property.

    (b)

    During the closure period, the property must be maintained and kept in good repair, including all grounds, landscaping, and parking areas.

    (c)

    If after 12 months of the closure, the property has deteriorated to a state of blight or the owners fail to demonstrate good faith efforts for reuse of the property, then a determination of abandonment may be established by the town and actions taken for cleanup of the site and its improvements. These actions may include cleanup of the site, its improvements and grounds, the remodeling of the structure to create a more marketable property, and the condemnation of the property for use as a town-owned or leased facility. The town may place a lien on the property to recoup any costs associated with the cleanup or reuse of the site.
