§ 74-59. Types and purpose.

  • Four types of permits apply to the different types of work that may be performed on a property:

    (1)

    Tree removal and oceanfront pruning permit. Tree removal and oceanfront pruning permit applies only when trees are to be removed to protect a structure or improvement on a property, to promote the health and growth of other more desirable vegetation, or to remove dead or diseased trees, or to improve the appearance and/or livability of the property without significantly destabilizing the soil thereon or of adjacent properties; or for pruning oceanfront maritime vegetation. No earth movement other than minor leveling of soil after tree removal is required. This permit is issued by the building inspector after approval by the community appearance commission.

    (2)

    Landscape permits. Landscape permits are of two types, one of which is required for all construction activity in the Town of Pine Knoll Shores. Any activity that may increase or has the potential to increase current or future impervious surface coverage will be subject to one of these two permits and the requirements of sections 74-289, 74-315, or section 74-334 as applicable.

    a.

    Minor landscape permit: Applies when development activity takes place having little or no land disturbance, no adverse drainage impact on adjacent properties, little or no tree removal, nor other adverse impact on adjacent properties. This permit is usually used for minor property improvements as determined by the building inspector.

    b.

    Major landscape permit: Applies when there is a significant change in topography of a lot that affects drainage, tree removal, and/or vistas of adjacent properties. Examples of this permit include new construction such as a subdivision, a house, or an addition or a swimming pool.

    Both types of landscape permits shall be issued in conjunction with a building permit. The building inspector, after reviewing the proposed project and its impact on the site and adjacent properties, will determine which permit type shall be requested by the applicant. No landscape permit, minor or major, will be issued until: (i) the applicant has also applied for and been issued a building permit for the construction activity necessitating a landscape permit; and (ii) the applicant has provided evidence that a contract for such construction has been awarded when such work will be performed by any person other than the applicant.

    (3)

    Building permit. Building permit applies to erection of a structure on a site. It is issued by the building inspector with approval by the community appearance commission.

    (4)

    Wireless telecommunications service facilities permit. There are three types of wireless telecommunications service facilities permits:

    a.

    Expedited permits. Applications for wireless telecommunications service facilities are eligible for expedited permits when they are eligible facilities requests or collocations as defined in section 74-2. However, collocations that meet the definition of "substantial modifications" shall have to submit the application requirements for a "substantial modification."

    b.

    Substantial modification permit. Applications for wireless telecommunications service facilities must be administered through the full review permit process when they are "substantial modifications" or otherwise do not meet the definition of "eligible facilities request."

    c.

    Wireless support structure permit. Applications for a new wireless support structure must be administered through the wireless support structure permitting process.

    d.

    Exemption. The permitting and approval requirements of this chapter do not apply to routine maintenance and does not limit the performance of routine maintenance on wireless support facilities, including in-kind replacement of wireless facilities. Routine maintenance includes activities associated with regular and general upkeep of transmission equipment, including the replacement of existing wireless facilities with facilities of the same size.

    (5)

    Sign permit. Unless specifically excluded by the terms of this chapter, no sign may be constructed without issuance of a permit by the town, and payment of a fee to the town as set by the board of commissioners in the town's fee schedule. The sign permit process is set forth in 74-168.
