§ 74-334. Maximum lot coverage.

  • (a)

    Impervious coverage, including, but not limited to roofs, driveways, paved walkways and paved patios, shall not exceed 50 percent of the parcel. Single-family residences constructed in multifamily-2 and institutional zoning districts shall be subject to the impervious surface requirements described in section 74-289.

    (b)

    Notwithstanding the provisions of this section, should impervious coverage on any parcel in a multifamily, office, commercial, professional, municipal service and institutional districts (collective "division 4 districts") as of the enactment of the ordinance codified herein exceed the limits established herein, the following shall apply. In the event of a casualty loss (i.e., unintentional loss), such parcel and the structures thereon shall be deemed conforming for maintenance and reconstruction of improvements in the event of damage, as long as the amount of impervious surface is not increased and complies with other regulations. In the event of new construction, demolition, damage, or destruction to structures with impervious coverage exceeding the limits above, resulting from the intentional act of the property owner or his agents, which results in the removal of less than 50 percent of the pre-existing structure footprint, redevelopment shall not exceed the pre-existing impervious footprint. In the event of demolition, damage, or destruction to structures with impervious coverage exceeding the limits above, resulting from the intentional act of the property owner or his agents, which results in the removal of 50 percent or more of the pre-existing structure footprint, redevelopment or, reconstruction shall be subject to this section and to the provisions relating to nonconformity set forth in article VII.

    (c)

    For casualty loss to single-family residences in the MF-2 zoning district, the provisions of section 74-289 shall apply. In the event of demolition, or intentional damage or destruction by the owner or his agents to structures on a lot used for a single-family residence in the MF-2 zoning district with impervious coverage exceeding the limits of section 74-289, the reconstruction shall be subject to the provisions of section 74-289.

    (d)

    Natural terrain shall be maintained with minimum disturbance to natural trees, maritime forest, and shrubs and minimum impact to adjacent properties.
