§ 38-10. Tattooing and body piercing prohibited within the city limits.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Body piercing means the piercing, puncturing, or cutting of the body of a human being so as to create a hole or opening for the purpose of inserting jewelry or other decoration. Body piercing includes piercing an ear, lip, tongue, nose, navel, eyebrow, genital, or other body part. Body piercing does not include piercing an earlobe with a disposable, single-use stud or solid needle that is applied by using a mechanical device to force the needle or stud through the earlobe.

    Tattooing means the inserting of permanent markings or coloration, or the producing of scars, upon or under human skin through puncturing by use of a needle or any other method.

    (b)

    Tattooing and body piercing prohibited . No person shall engage in tattooing or body piercing within the town.

    (c)

    Exemptions . Licensed physicians, as well as physician assistants and nurses working under the direct supervision of a licensed physician are exempt from this section. Licensed dentists and dental assistants working under the direct supervision of a licensed dentist are exempted from the prohibition on body piercing contained in subsection (b) of this section.

    (d)

    Severability. Should any provision of this section be deemed unenforceable by a court of law, such provision shall be deemed severed from this section, and the remaining provisions of the section shall remain in full force and effect.

    (e)

    Penalty . Violation of this section is a misdemeanor.
