§ 10-3. Residential fence regulations.

  • (a)

    Types of fences prohibited. Any fence which could cause harm to anyone coming into casual contact with it shall be prohibited. This prohibition includes, but is not limited to, any electrically charged fence and any fence containing barbs, spikes or other similar protrusions except for U.L. approved electrically charged fences not exceeding two feet in height used for the sole purpose of enclosing gardens.

    (b)

    Wire or chainlink fence restrictions. No wire or chainlink fence or chainlink gate shall be constructed between any public street and the primary residence located on the lot. This prohibition shall apply to both sides of a corner lot.

    (c)

    Position of "unfinished" side of fence. The more unfinished side of a fence shall be turned toward the property whose owner erects it or causes it to be erected.

    (d)

    Visibility of fence. Each fence shall be readily visible to anyone approaching it.

    (e)

    Maintenance of fences. Any fence constructed, whether of wood or other materials, shall be maintained by the owner of the fence in a safe condition. The owner of any fence, upon the request of the building inspector, shall make repairs and perform any maintenance required to maintain the fence in a safe condition.

    (f)

    Height of fence. No fence shall exceed five feet in height from grade.

    (g)

    Applicability. This section is applicable to residential zones only.
