§ 74-461. Building permit procedure.

  • (a)

    No wind energy system shall be erected or used in the town limits until the owner or occupant of the land on which the system is to be located submits an application to the building inspector and a building permit has been issued.

    (b)

    All applications for wind energy systems shall include the following:

    (1)

    Site plan;

    (2)

    Design plan of the wind energy system including turbine structure, tower, base and footings;

    (3)

    Wind system specifications;

    (4)

    Construction plan;

    (5)

    Operation and maintenance plans and specifications;

    (6)

    Shutdown procedures;

    (7)

    Certification by a North Carolina licensed professional engineer that the wind energy system:

    a.

    Can withstand a minimum wind velocity of 150 MPH; and

    b.

    Poses no obvious threat to the environment.

    (8)

    Evidence of at least $500,000.00 of general liability insurance coverage as part of a homeowners insurance policy, as "umbrella coverage", or otherwise;

    (9)

    Any county, state and federal permits required by law or regulation; and

    (10)

    Such other relevant information as the building inspector may require.

    (c)

    Prior to issuance of a building permit for a wind energy system the building inspector will submit the same to the planning board for review and comment on compliance with the terms of this article.
