§ 74-379. Purpose.

  • The conditional zoning process is established to address those situations involving a rezoning when either: a) a particular use permitted in an existing zoning district may be acceptable for a property but other permitted uses in the zoning district would not be acceptable; or b) a particular use may be acceptable on a particular property, but that use would not be acceptable for the entirety of an existing zoning district, or a particular use would be appropriate for a particular property and compatible with the surrounds, but that use is not listed in any zoning district. It allows the board of commissioners to approve a rezoning proposal for a specific use with reasonable conditions to ensure the compatibility of the use with surrounding properties. This is an alternative procedure which is intended for firm development proposals. It is not intended or suited for securing early zoning for tentative proposals which may not be undertaken for some time. These proceedings may only be initiated at the request of the property owner or the property owner's agent.
