§ 74-358. Office and professional district OP and restrictions thereon.

  • (a)

    Property in the office and professional district may be used for the following purposes:

    (1)

    Churches, hospitals, educational facilities, libraries and similar uses;

    (2)

    Offices rendering professional services, such as medical, dental, legal, accounting, engineering, architectural, and scientific research;

    (3)

    Offices rendering specialized services, such as real estate, stock brokerage, advertising, travel, stenographic, telephone and insurance;

    (4)

    General business offices not involving sale of merchandise on the premises, or storage of merchandise or equipment;

    (5)

    Banks and other financial institutions; and

    (6)

    Other uses compatible with the foregoing as determined by the board of commissioners.

    (b)

    The following uses are specifically prohibited:

    (1)

    Retail selling of merchandise from stock;

    (2)

    Restaurants; and

    (3)

    Storage of merchandise or equipment intended for sale.

    (c)

    Other restrictions:

    (1)

    Where office and professional district property is contiguous to any property zoned residential, there shall remain on the OP property a 50-foot buffer strip adjacent to the residential property, which buffer strip shall either remain in its natural state or be landscaped in a manner acceptable to the town community appearance commission;

    (2)

    No building shall be constructed within 50 feet of any street right-of-way;

    (3)

    No building or parking area shall be constructed within 20 feet of any adjoining property line;

    (4)

    No parking area shall be constructed within 25 feet of any street right-of-way;

    (5)

    No more than 25 percent of the total site area shall be occupied by a structure or structures, and no more than 65 percent of the total area shall be occupied by structures, driveways, walkways, and parking areas, so that at least 35 percent of the total area shall remain in natural or landscaped state;

    (6)

    Maximum building height shall be 35 feet measured from the lowest finished grade level of the building foundation or pilings to the highest point of the building;

    (7)

    The number of vehicular entrances shall be determined by the board of commissioners, based on the site plan and other prevailing circumstances;

    (8)

    All driveways and parking areas shall be graded, stabilized and constructed so as to provide adequate drainage of surface water. All driveways shall be paved to standards of private streets as set out in chapter 54, pertaining to subdivisions. All parking areas shall be paved; and

    (9)

    One parking space shall be provided for every 200 feet of interior floor space.

    (d)

    The only signs permitted within the office and professional zone shall be wall signs, ground signs, and window signs.

    (e)

    There shall be allowed one ground sign per use (or group of related uses, sharing a common parking facility), which ground sign shall not exceed 50 square feet in size. Should there be only one use on a lot, there may be either a ground sign or a wall sign, but not both. Should a wall sign be chosen, its maximum size shall be 30 square feet. In addition, one window sign per use shall be allowed, with its size not exceeding ten square feet measured by its frame.

    (f)

    Other signs may be located in the office and professional zoning district as allowable under Sections 74-221 and 74-222.
