§ 74-238. Descriptions and purposes of the districts.

  • (a)

    Residential districts R-1, R-2, R-3 and R-4. The R-1, R-2, R-3 and R-4 residential districts are established as districts in which the principal use of the land is for dwellings. In promoting the general purposes of this chapter, the specific intent of these districts is:

    (1)

    To encourage the construction of and the continued use of the land for single-family dwellings;

    (2)

    To restrict commercial use and prohibit industrial use of the land and to prohibit any other use which would substantially interfere with development or dwellings in these districts;

    (3)

    To discourage any use which would generate traffic on minor streets other than normal street traffic to serve residences on those streets;

    (4)

    To discourage the continuance of existing uses that would not be permitted as new uses under the provisions of these districts;

    (5)

    To discourage any use which because of its character or size would create requirements and costs for public services, such as police and fire protection, water supply and sewerage, substantially in excess of such requirements and costs if the district were developed solely for dwellings.

    (b)

    Recreation districts Rec-1, Rec-2 and Rec-3. The Rec-1, Rec-2 and Rec-3 recreation districts are established as districts in which the principal use of the land is for recreation, both public and private. In promoting the general purpose of this chapter, the specific intent of these districts is:

    (1)

    To encourage the development of recreation facilities throughout the community.

    (2)

    To restrict those uses which would substantially interfere with the nature of these districts.

    (c)

    Multifamily districts. The multifamily districts are established as districts in which the principal use of the land is for multifamily dwellings. In promoting the general purposes of this chapter, the specific intent of these districts is:

    (1)

    To encourage the construction of and the continued use of the land for multifamily dwellings;

    (2)

    To restrict commercial use and prohibit industrial use of the land and to prohibit any other use of which would substantially interfere with the development of multifamily dwellings in these districts;

    (3)

    To discourage the continuance of existing uses that would not be permitted as new uses under the provisions of this district;

    (4)

    To permit a concentrated, intensive development of the permitted uses while maintaining a substantial relationship between the intensity of land use and the capacity of utilities and streets.

    (d)

    Commercial district. The commercial district is established as a district in which the principal use of land is for commercial and service uses to serve the needs of the community. In promoting the general purpose of this chapter, the specific intent of this district is:

    (1)

    To provide for the planning and construction of commercial and service facilities to serve the needs of the town;

    (2)

    To promote a unified and functional character for such an area;

    (3)

    To protect the value of neighboring properties;

    (4)

    To protect the natural environment as much as possible;

    (5)

    To protect the public from unnecessary health and traffic hazards.

    (e)

    Office and professional district OP. The office and professional district is established as a district in which the principal use of land is for office and professional service facilities to serve the needs of the community. In promoting the general purposes of this chapter, the specific intent of this district is:

    (1)

    To provide for the planning and construction of office and professional service facilities to serve the needs of the town;

    (2)

    To promote a unified and functional character for such area;

    (3)

    To protect the value of neighboring properties;

    (4)

    To protect the natural environment as much as possible;

    (5)

    To protect the public from unnecessary health and traffic hazards.

    (f)

    Municipal service district MS. The municipal service district is established as a district in which the principal use of land is for those facilities needed to provide for the governmental, administrative, service and utility needs of the community. In promoting the general purpose of this chapter, the specific intent of this district is:

    (1)

    To provide for the location of those governmental, administrative, police, fire, reserve, utility and service facilities necessary for the safe operation of the town;

    (2)

    To protect the value of neighboring properties;

    (3)

    To protect the natural environment as much as possible;

    (4)

    To protect the public from unnecessary health and traffic hazards.

    (g)

    Institutional district I. The institutional district is established as a district in which the principal use of land is for religious and educational facilities and their accessory uses. In promoting the general purposes of this chapter, the specific intent of this district is:

    (1)

    To provide for the location of religious and educational facilities and related accessory uses;

    (2)

    To protect the value of neighboring properties;

    (3)

    To protect the natural environment as much as possible;

    (4)

    To protect the public from unnecessary health and traffic hazards.
