§ 66-2. Definition of terms.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Block means a parcel of land, which is bounded on all sides by public streets, highways, railroad right-of-way, parks or green strips, rural land or drainage channels, bodies of water, or a combination thereof.

    Building setback line means a line parallel to the front property line in front of which no structure shall be built.

    Corner lot means a lot abutting upon two streets at their intersection.

    Dedication means a gift, by the owner, of a right to use land for stated purposes. Since a transfer of an interest in property is involved, the dedication shall be made by written instrument and shall be completed with an acceptance.

    Double-frontage lot means a continuous (through) lot which is accessible from both of the parallel streets upon which it fronts.

    Easement means a grant by the property owner for use, by the public, a corporation or person of a strip or parcel of land for specific purposes.

    Group development means a group of two or more principal structures or a "project" as defined in chapter 70, pertaining to zoning, built on a single lot, tract, or parcel of land not subdivided into the customary streets or lots and designed for occupancy by separate families, firms, businesses, or other enterprises.

    Lot means a portion of a subdivision, or any parcel of land, intended as a unit for transfer of ownership or for development or both. The word "lot" includes the words "plat" and "parcel."

    Official plans means any maps, plans, chart, text or ordinance officially adopted by the board of commissioners of the Town of Pine Knoll Shores as a guide for the development of the town.

    Reservation means a reservation of land which does not involve any transfer of property rights. It may simply constitute an obligation to keep property free from development for a stated period of time.

    Shall is always mandatory.

    Street means a dedicated and accepted public right-of-way which affords the principal means of vehicular access to abutting properties.

    Subdivider or developer means a person, firm or corporation who or which has applied for approval of or who has duly recorded a plat for the subdivision of a tract of land pursuant to the jurisdiction and requirements of this chapter.

    Tract means a parcel of land, under single ownership, which has not previously been approved by a board of commissioners as a single-family residential building lot.

    Zero lot line means a waiver of the side and/or rear minimum building line requirements to achieve design flexibility while complying with all applicable state and local building codes.
