§ 58-6. Surfing, swimming, and windsurfing.

  • (a)

    Surfing prohibited in certain areas. It shall be unlawful for any person to surf using a surfboard or similar device, or to have a surfboard or other similar device, in the waters of the Atlantic Ocean within the town within 200 feet from the centerline of any commercial fishing pier except in surfing events sponsored or approved by the pier. Pier owners shall be responsible for clearly delineating the restricted area by posting signs near the water's edge in the vicinity of the restricted area.

    (b)

    Surfboard ankle straps. Any person while in the waters of the Atlantic Ocean within the town with a surfboard must at all times have attached to his ankle a strap or shock cord which is a minimum of four feet in length and which is attached to his surfboard.

    (c)

    Windsurfing prohibited in certain areas. Any person using or riding on any surfboard which contains a mast and sail or using or riding upon any device generally known as a "windsurfer" shall not be allowed to use the same or to be in the water with such device within the restricted area designated in subsection (a) of this section.

    (d)

    Swimming near piers restricted. It shall be unlawful for any person to swim, float on a floatation device, or body surf under a pier or beyond the shore break of the Atlantic Ocean within 50 feet from the centerline of any commercial fishing pier, except during swimming or body surfing events sponsored by the commercial fishing pier. Pier owners shall be responsible for clearly delineating the restricted area by posting signs near the water's edge in the vicinity of the restricted area.
