§ 58-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Boat means every description of watercraft or structure used or capable of being used as a means of transportation on water, and shall include but not be limited to skiffs, yachts, motor boats, row boats, sailing boats, trawlers, barges, rafts, pontoon boats, ships, and personal water craft (such as jet skis and wave runners).

    Boat basin means area constructed within the corporate limits of the town for the purpose of launching, retrieving and/or mooring of boats.

    Boat slip means any area excavated landward of the mean high-water mark or established bulkhead line on navigable waters within the corporate limits of the town.

    Cove means the three areas of the PKS Canal which are branched off the main navigable waterway, and are located at Kings Corner, Davis Landing, and Hoppers Hideaway.

    Dock or pier means a structure or floating platform (whether such platform is registered as a boat or not), or combination of structure and floating platform, extending into or over the water used for mooring boats, loading and unloading boats, swimming, or lounging. No roofed structure, including a boathouse, is permitted on or as a part of a dock or pier.

    Dry stack storage means either the temporary or indefinite storage of boats or other watercraft on racks or other devices where boats or watercraft are stacked one on top of the other. This does not apply to canoe racks or similar type structures.

    Navigable waterway means any body of water, channel or boat basin located within the corporate limits of the town which may be utilized by boat traffic.

    Outrigger piling means a post placed in a waterway for mooring a boat or as support for a boatlift.

    Structure means anything constructed or erected within, above, or extending over any watercourse or waterway, or within or extending over or immediately adjacent to the high-water mark of any watercourse or waterway. Structure shall include, but is not limited to, docks, seawalls, boathouses, shelters, piers, decks, piling, davits or devices intended to move, lift or store boats of any kind.
