All claims or demands against the Town arising in tort shall be presented to the Board
of Commissioners in writing, signed by the claimant or his attorney or agent, within
ninety (90) days after such claim or demand is due or the cause of action accrues.
No suit or action shall be brought on such a claim or demand within thirty (30) days
or after the expiration of twelve (12) months from the time such claim or demand is
presented. Unless the said claim or demand is so presented within ninety (90) days,
and unless suit is brought within twelve (12) months thereafter, any action thereon
shall be barred.

west 754.56 feet to an existing concrete monument; thence running north 05 degrees
43 minutes 43.77 seconds west 268 feet to a point in the low water mark of Bogue Sound;
then running along the mean low water mark of Bogue Sound the following courses and
distances -south 76 degrees 55 minutes 55 seconds east 210.65 feet to a point, north
36 degrees 23 minutes 25.37 seconds east 398.61 feet to a point, south 87 degrees
31 minutes 09 seconds east 894.15 feet to a point, south 82 degrees 39 minutes 15
seconds east 355.01 to the point and place of beginning.
